Sweepstakes registration data and the referral email addresses and names provided by entrants are processed in the United States and in accordance with U.S. privacy law.

The $10,000 Window Sweepstakes winner will receive the installation or replacement of windows not to exceed the sum of $10,000. In the event that you enter the Sweepstakes and, at any time before December 31, 2010, enter into a contract with Frey Construction & Home Improvement, LLC for the installation or replacement of windows, and you subsequently win the Sweepstakes prize, you will be compensated for the amount of your contract, not to exceed $10,000, as soon as your contract is completed and paid in full.

1.      Description of Sweepstakes – Frey Construction & Home Improvement, LLC, (the “Sponsor) is offering a $10,000 windows giveaway sweepstakes (the “Sweepstakes”) and will award prizes on a random selection basis from all valid entrants in the Sweepstakes. The Sweepstakes begins 12:01 AM US Central Time (CT) on January 8th, 2010 and ends at 11:59 PM US CT on December 31st, 2010 (“Sweepstakes Period”).

 

2.      Eligibility – The Sweepstakes is open to legal residents of Sauk, Dane, Iowa or Columbia Counties, Wisconsin. Entrants must be homeowners and must demonstrate such in order to collect the prizes. Employees, officers and representatives (and members of their immediate families and those living in the same household of each) of Frey Construction, its affiliated companies, its advertising and promotion agencies and any company involved in the design, execution, or production of the Sweepstakes are not eligible. Promotion is void where prohibited or restricted by law.

 

3.      How to Enter – Fill out the supplied form, or visit www.freyconstruction.com/entercontest.htm to enter. Enter all of the information required in the fields marked with an “*” and hit the “submit” button. By hitting the “submit” button you give Frey Construction permission to contact you for the purpose of confirming your entry in this contest and to offer you a free in-home product demonstration regardless of whether you have signed up for the “Do Not Call Registry”. You are not required to agree to an inspection (or an in-home demonstration of Frey Construction) in order to qualify to receive the prizes, described below.

 

In the alternative, an email may be sent to info@freyconstruction.com with the subject line reading “Frey Construction Window Sweepstakes” or by mailing a postcard to 530 Park Avenue, Prairie du Sac, WI 53578. These alternative submissions must contain all of the information required to be entered on the submission page above including first name, last name, phone number, email address, mailing address and physical property address (if different from mailing address). In the event you choose to register via email or postcard, you may be contacted to verify information in the email or postcard and to offer you a free in-home product demonstration. There is a limit of one sweepstakes entry per person/household per month. Sponsor reserves the right to disqualify any person or household that submits more than one entry. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

 

By entering, you agree to be bound by these Official Rules. All entries must be completed entirely and contain accurate information. All entrants will be contacted by a representative of Frey Construction to validate your Sweepstakes entry. Once your entry is validated, you may request a free in-home product demonstration. After you receive your free in-home product demonstration, you will be put into the drawing for the Grand Prize.

 

4.      Grand Prize and Odds of Winning:

Sweepstakes prizes will be awarded to the winners as follows:

·         One Grand Prize: $10,000 Worth of Windows – including installation.*

*The normal cost that Frey Construction & Home Improvement, LLC offers in the purchase and installation of windows will not be increased to cover the cost of the prizes awarded. If the Grand Prize winner has the work completed prior to being selected the Winner, the contract price will be based upon routine pricing and policy.

·         (3) $1,000 Prizes: $1,000 credit towards any home improvement project from Frey Construction.

 

 

a.       Frey Construction will provide tear out services for the Grand Prize winner’s existing windows (if required) at no charge. Frey Construction will install the new windows according to the manufacturer’s recommendations, and trim them appropriately to the house at no charge to the customer.

b.      This contest does not specifically include or exclude patio doors, bay windows, bow windows, or any other kind of specialty window as an option.

c.       This Sweepstakes is intended for either replacement of old existing windows or windows provided for new construction.

d.      This does not include installing windows in walls where none existed before, or moving windows to a new location. It also does not include reducing or enlarging the opening size of existing windows. These services are available at an additional charge to the customer.

e.       This Sweepstakes does not include framing services.

f.        Finishing, including painting and staining is not included in this giveaway. These services are available at an additional charge to the customer

g.       Note: repair of dry rot or the need for additional sheeting underneath the windows or doors is not included in the giveaway and would incur additional charges to the customer.

h.       These issues will be negotiated with the Grand Prize winner at the time of award.

 

The odds of winning are dependent on the number of eligible entries received during the Sweepstakes period.

 

5.      General: You must be registered with Frey Construction (through the website, filling out the provided form, or by submitting an email or postcard as described above) at the time of winner selection to be eligible for the Prize. Grand Prize winner will be selected in random drawing, in-house by our employees. Drawing will be conducted on or about January 15, 2011, and the winners will be notified by phone and/or mail within 2 days of the drawing. Winners will be required to complete the Affidavit of Eligibility and a Liability/Publicity Release (unless prohibited by law). The Affidavit and Liability/Publicity Release must be returned within (10) days of receipt of these documents. Winners will also be required to send a copy of his/her passport, driver’s license, birth certificate or other appropriate documentation (acceptable by Sponsor) as proof of identity and residency. Non-compliance with any of these requirements will result in disqualification, in which case an alternative winter will be chosen. Return of prize notification and/or Affidavit/Release as undeliverable will result in disqualification and an alternate winner will be selected.

The prizes are not transferrable, either to another person, or to another home. The prizes cannot be redeemed for cash, and there are no substitutions or cash options available. If, for reasons beyond the Sponsor’s control (including, but not limited to, tampering or computer virus infection), the Sweepstakes is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Sweepstakes (without liability) and to the extent feasible, will award prizes among entries received prior to cancellation or modification. Sponsor will not be responsible for lost, late, or misdirected, entries or the Internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays. Entries are void if they contain material, typographical or other errors. Entries, which are incomplete, inaccurate, forged, irregular in any way, or created by repetitive programming or are otherwise not in compliance with these Official Rules, are also void.

All entrants agree to comply fully with each provision of these Official Rules. Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules, will be ineligible for any prize(s) and may be prosecuted to the full extent of the law.

By submitting an Entry, you grant Frey Construction, the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), voice, biographical information, and written or oral statements, for advertising and promotional purposes in promoting or publicizing Frey Construction and its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), biographical information, or entry.

ANY AND ALL TAX LIABILITY OF ANY KIND RESULITING FROM A WINNER’S RECEIPT OF THE PRIZE IS THE RESPONSIBILITY OF THE WINNER.

6.      Release of Liability and Issues of Law: By participating in this Sweepstakes, all entrants release Frey Construction, its subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this promotion from any and all liability with respect to and in any way arising from participating in this promotion, acceptance or use of prizes. Entrants also agree that Frey Construction, its subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this promotion are not responsible or liable for any injury or damage to an entrant’s or third person’s computer related to or resulting from the Sweepstakes, the Entries and/or its prizes. The Sponsor is not liable for damage to a user’s computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an entrant’s participation in the Sweepstakes or downloading of information in connection with the Sweepstakes. The Sponsor reserves the right to modify or cancel the Sweepstakes in the event that any portion of any website used to administer any aspect of the Sweepstakes becomes technically corrupted.

 

All Federal, state and local laws and regulations are applicable. THE WISCONSIN STATE COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF WISCONSIN SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS. The Sweepstakes is void where restricted or prohibited by law.

 

7.      Information About the Winner: For the name of the winner, send a stamped, self-addressed envelope to 530 Park Avenue, Prairie du Sac, WI 53578. Requests must be postmarked no later than January 31st, 2011.
